Is it illegal for someone to come into a furniture shop and start taking pictures?

Question by Shellie: Is it illegal for someone to come into a furniture shop and start taking pictures?
There is an ongoing despute between my friend who owns a furniture shop and a customer over a sofa. They sent an upholsterer in to the shop with a camera to take pictures without the owner’s permission to help with their case. Is this illegal?

Your question is unclear. And I’m not a lawyer, so this isn’t legal advice.

However, the store owner has a right to admit, or not admit, anyone to the store. If a person enters without the owner’s permission, the owner can call the police and have the person charged with trespassing. So the owner can keep someone out.

However, who owns the sofa? If it’s the store owner, then we’re still in the trespassing scenario. If the customer owners the sofa, it would still be trespassing, but the owner could make an argument that the owner has right to access their own property.

Check with a lawyer for more information.
